Contest Participation Terms and Conditions

1. Organizer

1.a
The organizer of the sweepstakes is L.CREDI-Peugler GmbH, represented by Managing Director Florian Straßmeier. The participation period is from 02/16/2024 0:00 to 06/12/2024, 23:59, and takes place on lcredi.com.

1.b This sweepstakes is not associated with Facebook or any other social media provider where this sweepstakes may be announced.

1.c The organizer reserves the right to cancel or terminate the sweepstakes without prior notice due to unforeseen circumstances (especially technical or legal reasons).

2. Sweepstakes

2.a The organizer is conducting three sweepstakes. For this purpose, one or more prizes have been provided and will be awarded to the winner(s) according to the following conditions.

2.b Within a few days after the participation deadline, the winners will be selected by random drawing among all participants and notified by the organizer. The winners will then be informed by email and have one week to claim their prize; otherwise, the claim expires and a new drawing will take place. A total of three winners will be drawn for the sweepstakes.

2.d Three gift packages will be raffled, each consisting of 1x fan jersey in a size of choice and 1x L.CREDI bag of choice. The prize cannot be transferred or redeemed at another time. Cash redemption is also not possible.

2.e The prizes will be sent to the winners’ addresses. For this, the participant must agree to provide the organizer with a delivery address.

2.f The organizer reserves the right to change these terms and conditions without prior notice or to cancel the sweepstakes without giving reasons if the proper conduct of the sweepstakes can no longer be guaranteed for technical, legal, or other reasons. When exercising these rights, the organizer will consider the interests of the participants, especially ensuring that exercising these rights is reasonable for the participants.

3. Participation

3.a By participating, participants agree to the terms and conditions.

3.b Eligibility to participate

3.b.I Sweepstakes Webshop: Eligible to participate are all persons who place an order on lcredi.com between 02 and 06/12. Multiple entries by the same person for the same sweepstakes will not be considered. Employees of L.CREDI-Peugler GmbH are excluded from participation.

3.b.II Sweepstakes on @lcredimunich Instagram: Eligible to participate are all persons who follow @lcredimunich, like the related post, and tag two friends. Multiple entries by the same person for the same sweepstakes are possible by sharing the post in their stories. Employees of L.CREDI-Peugler GmbH are excluded from participation.

3.b.II Sweepstakes on Meta & Google: Eligible to participate are all persons who enter their email address for the respective sweepstakes. Multiple entries by the same person for the same sweepstakes will not be considered. Employees of L.CREDI-Peugler GmbH are excluded from participation.

3.c Participation in the sweepstakes is free of charge. Internet access and a Facebook and/or Instagram account are required for participation; any related costs must be borne by the participants.

3.d A participant is always a specific natural person; legal entities cannot participate. Multiple participation, for example under a pseudonym or additional email addresses, is excluded and leads to exclusion from the sweepstakes.

3.e The conditions for participation must be met during the duration of the sweepstakes and submitted to the organizer via the offered method. Participation by any other means than the one offered (e.g., a different email address of the organizer) is excluded and will not be considered. Applications submitted before or after the participation period will not be considered.

3.f Participation by minors with limited legal capacity is only possible from the age of 14 and only with the consent of their legal representatives.

3.g The organizer reserves the right to exclude participants from the sweepstakes who violate the terms and conditions, especially those who participate multiple times, provide false information, use unauthorized aids, or otherwise gain or attempt to gain an advantage through manipulation.

4. Data Protection

4.a The participant data provided during participation will be collected, processed, and used by the organizer exclusively for the purpose of conducting this sweepstakes. This data will be treated confidentially, not passed on to third parties, and not used for advertising purposes.

4.b A prerequisite for participation in the sweepstakes is that the participant provides the necessary information listed under section 3. Otherwise, participation is not possible. The organizer processes the email address, first name, and last name to contact the winners and to collect any further necessary data for accepting and sending the prize, such as the address.

4.c The legal basis for processing is Art. 6 para. 1 lit. b GDPR. The data will be deleted no later than 90 days after the sweepstakes ends, except for the data of winners who have accepted the prize. Their data will be retained for the duration of the statutory retention periods and then deleted.

4.e At https://lcredi-munich.de/pages/kontakt, participants can request information from the organizer at any time about which personal data is stored, request correction or deletion, and revoke any given consents.

5. Legal Recourse and Liability

Legal recourse is excluded. There is no enforceable claim to the payment of prizes. L.Credi-Peugler GmbH is not liable for loss, delay, alteration, manipulation, and/or misdirection of emails and/or data during data entry, recording, transmission, and/or storage caused by external data networks, especially the internet or the WWW, external telephone lines, and/or other hardware and/or software of participants and/or third parties; this also includes faulty, missing, interrupted, deleted, or defective data. L.Credi-Peugler GmbH is also not liable for incorrect information caused by participants and/or third parties, their hardware and/or software, which is required for or related to the sweepstakes. In particular, no liability is assumed if emails or data entries do not meet the specified requirements and are therefore not accepted or processed by the system. Furthermore, L.Credi-Peugler GmbH is not liable for theft or destruction of data storage systems and/or media or unauthorized alteration and/or manipulation of data in the systems and/or on the storage media by participants or third parties. Otherwise, L.Credi-Peugler is only liable for gross negligence or intentional acts of its legal representatives, employees, or vicarious agents. L.Credi-Peugler is also not liable for damages suffered by winners or their relatives in connection with the prize. The above exclusion of liability does not apply where mandatory liability exists, e.g., in cases of intent, gross negligence, injury to life, body, or health, or breach of essential contractual obligations. However, the claim for damages for breach of essential contractual obligations is limited to the three typical, foreseeable damages unless liability arises from intent, gross negligence, or injury to life, body, or health. The above provisions do not change the burden of proof to the disadvantage of the participants.
